The decision to introduce the changes to the Law on Telecommunications was made by the National Assembly of the Republic of Azerbaijan in accordance with Paragraph 23 of Part I of Article 94 of the Constitution of the Republic of Azerbaijan.
Under the changes, Paragraphs 33.1.3-1, 34.1.2-1, and 40.3.7-1 were added to the Law on Telecommunications.
Paragraphs 33.1.3-1 stipulates measures ensuring the safe use of information resources. These measures are taken based on subscribers’ appeals to protect children against the harmful information that may cause damage to their health and hamper their development.
Paragraphs 34.1.2-1 stipulates measures ensuring the protection of children from the harmful information that may cause damage to their health and hamper their development.
Paragraphs 40.3.7-1 specifies that subscriber’s consent (objection) is required for taking measures on protecting children against the harmful information that may cause damage to their health and hamper their development.
These amendments to the Low on Telecommunications will contribute to ensuring a high level of internet safety of children in Azerbaijan. The changes call for telecommunications operators and Internet service providers to exercise more responsibility in protecting children from harmful information on the Internet.
At the same time, the President of the Republic of Azerbaijan signed an order on application of the Law on Amendments to the Law of the Republic of Azerbaijan on Telecommunications.
According to the order, the Cabinet of Ministers will prepare proposals on conforming the laws of the Republic of Azerbaijan and acts of the President of the Republic of Azerbaijan to the Law on Amendments to the Law of the Republic of Azerbaijan on Telecommunications within three months and submit them to the President of the Republic of Azerbaijan, ensure the conforming of the legal acts of the Cabinet of Ministers of the Republic of Azerbaijan to this law within three months and inform the President of the Republic of Azerbaijan of it, supervise measures to be taken to ensure the conforming of the legal acts of the central executive bodies with the Law on Amendments to the Law of the Republic of Azerbaijan on Telecommunications and inform the President of the Republic of Azerbaijan of the execution of these measures within five months, resolve other issues arising from this law.
Also, under the order, the Ministry of Justice of the Republic of Azerbaijan will ensure the conforming of the legal acts of central executive bodies to the Law on Amendments to the Law of the Republic of Azerbaijan on Telecommunications and inform the Cabinet of Ministers of the Republic of Azerbaijan of it.
Changes made to Law on Telecommunications
